How Understaffed And Underpaid Nursing Homes Foster Abuse

It’s no secret that nursing home abuse is widespread throughout the United States. In their quest to increase their profits, nursing home owners are habitually understaffing and underpaying the people that they hire who are responsible for caring for our nation’s elderly.

Consequently, in addition to having to deal with infirmity, illness, and disability, the residents of assisted living facilities and nursing homes often are subject to potentially lethal abuse from the staff as well as from each other.

An article that appeared in the New Orleans Times-Picayune on April 20, 2006 entitled “Lethal Threat” noted that inspectors had been investigating abusive behavior by a resident in a nursing home who suffered from Alzheimer’s disease. The resident suffered from psychotic delusional and aggressive behavior.

During their investigation the inspectors noted that two nurses on the staff of the long term facility had said that “it was overwhelming and difficult for one nurse to provide the needed care for 50-56 residents on this Alzheimer’s unit.”

It’s not surprising, then, that there are hundreds of records of reported abuse that range from staff members slapping, hitting, and shouting at residents to residents scratching, slapping, beating, and raping each other.

The worst abuse happens in homes that are inadequately staffed. Aides who are often not trained to deal with diseases such as Alzheimer’s are often assigned to cover more duties than they are able to handle.

Nursing Home Staff Abuse

Many of the alleged cases of abuse in these homes seem to center on the least trained and lowest paid members of the nursing home staff. These are the certified nursing assistants. Their responsibility is to help the residents with their day-to-day activities such as dressing, personal grooming, bathing, and eating their meals.

Nursing Home Abuse By Residents

However, one of the most disturbing types of abuse found by the state’s inspectors involves sexual assaults and rape.

A nursing assistant in Lake Charles, New Orleans, at the Martin de Porres nursing home, told a state inspector in May 1999 that a thirty seven year old female resident at the home who suffered from “profound mental retardation” and autism was repeatedly being raped by the male residents.

In their report the state inspectors said that a housekeeper revealed that in March 1999 he had discovered the woman being pinned against a wall and being raped by a male resident. He said he yelled at the man to stop and reported what happened to the nursing home’s director of nursing.

The housekeeper said that the director said the woman “has feelings, wants, and needs.” The director added that “if the sex was consensual, ‘just close the door.’”

Although the records indicate that a couple of months later the Sheriff’s Office was contacted, there aren’t any records of that any charges were filed. In addition, the state files were purged so there isn’t any information as to whether or not the home was sanctioned.

Sexual assaults as well as other types of assaults are often reduced at facilities that have an adequately sized and well trained nursing home staff. If you are looking for a nursing home for your loved one then one of the first things that you should do is ascertain the size and quality of the staff.

What is Nursing Home Abuse & Neglect?

There are four general categories nursing home abuse and neglect can fall into. They include:

1.Harmful Neglect
If a resident in a health care facility experiences bed sores, suspicious or questionable injuries or death, unexplained substantial weight loss or severe dehydration they may be a victim of harmful neglect.

2.Assault and Battery
If an employee of a nursing home or residential health care facility threatens or strikes a resident or uses unauthorized physical or chemical restraints assault and battery has been committed.

3.Criminal Sexual Conduct
If an employee of a nursing home or residential care facility engages in unlawful sexual contact with a patient criminal sexual conduct has occurred.

4.Embezzlement/Theft
If an employee of a nursing home or residential care facility wrongfully removes funds from a resident’s account, improperly obtains a financial “loan” or “gift” from a resident, or an employee uses privileged/personal information illegally to obtain credit cards, etc., resulting in identity theft embezzlement has occurred.

Which Health Care Facilities Are Subject To Investigate Nursing Home Abuse & Neglect?

Any resident and/or patient receiving treatment or care in a residential health care facility is entitled to proper investigation. Listed below are a few examples of facilities in which the Michigan Office of the Attorney General has jurisdiction to investigate criminal abuse and neglect.

Nursing Homes

Hospital Long-Term Care Units

Homes for the Aged

County Medical Care Facilities

Adult Foster Care Facilities

Assisted Living Facilities

Nursing Home Neglect – What Should You Do?

If you or a family member suspect you have been a victim of nursing home abuse and neglect you should know there are certain things you should do to protect yourself. First and foremost report the incident IMMEDIATELY. Report it to the facility’s administrator, director of nursing, charge nurse, social worker, or the facility’s designated patient advocate. It can be verbally or by letter but make sure to report the incident.

Second, obtain photographs of the physical injury and make a written statement detailing what you observed, when you observed it, who was present, and any other information that may be of assistance to an investigator.

Third, you should contact an experienced nursing home neglect lawyer to discuss your legal rights and get compensation for the injuries you suffered. If it is found that nursing home abuse and neglect has been performed, a lawsuit could prevent such tragedy from happening to another resident.

Medicare fraud and abuse cost taxpayers approximately billion a year. It’s one of the fastest and most profitable crimes in the U.S. The government health insurance program that covers 46 million elderly and disabled Americans is being hijacked by opportunists preying on patients, doctors, suppliers, and lack of oversight of the system itself.

According to President Obama, Medicare fraud and abuse is fueling enormous federal budget deficits. He recently explained that we could pay for healthcare reform if we could eliminate Medicare fraud, abuse, and waste altogether.

Although completely eliminating Medicare fraud isn’t entirely realistic, curbing the growing crimes could provide healthcare to many more Americans and stop lining the pockets of the individuals, crime rings, and corrupt healthcare providers that steal a huge amount of the half trillion dollars in Medicare benefits each year.

The instances of Medicare fraud and abuse are as diverse as they are widespread. One recent high-profile case involved an Armenian-American crime syndicate that stole patient and doctor identities to setup dozens of fake clinics. The operation, which is one of the largest Medicare fraud schemes in U.S. history, resulted in over million in illegal billings.

In another Medicare fraud and abuse case, nine hospitals in seven states were ordered to pay .4 million in fines for keeping patients overnight after undergoing what is typically an outpatient back procedure. The hospitals fraudulently billed Medicare for the unnecessary services. In still another case, eight nurses in Florida carried out an .7 million Medicare fraud scam in which they forged patient files to make it appear that they required home health care services that they didn’t need or receive.

Although these are just a few of the many types of Medicare fraud and abuse scams occurring each year, they show the urgent need to be vigilant about preventing Medicare scams. From charging for durable medical equipment (DME) never received to using a deceased doctor’s information to continue to bill patients, common Medicare fraud and abuse schemes include:

Advertising “free” consultations to patients with Medicare, and then recording and using their private information for monetary gain

Offering healthcare services or DME for free in return for a person’s Medicare number for “record keeping”

Setting up fictitious clinics with people impersonating doctors to steal private information and commit medical identity theft is another common Medicare fraud and abuse tactic

Using real patients’ data, but without their knowledge, to steal their identities

Not adhering to the FTC Red Flag Rules that alert the carriers paying the bills

Fraudulent billing for a wheelchair, specialized hospital bed, or other DME is also a form of Medicare fraud and abuse

Falsifying claims for expensive procedures is another common tactic, such as the .8 million fraudulent HIV infusion scheme in Miami in which a husband and wife team defrauded Medicare by submitting unnecessary HIV injection and infusion claims

I am a man of 54 years now. But despite seeing so many things in my life and experiencing all the emotions, I feel hurt when I am verbally abused. It is not that verbal abuse does not hurt. Some people think that verbal abuse can be easily forgotten and one may go forward. Yes, one goes forward but the scars of the wound inflicted by the verbal abuse go along with many of us. How about a child?

A child can be verbally abused in many ways. Children abusing each other with name calling etc. are common. But worse is verbal abuse by elders. Parents, relatives and teachers form part of this group in a child’s life. Many parents have set ideas about how a child should behave. If the child does not behave that away, the parents do not explain them the right way but make fun of them verbally. If such fun is made in presence of others the child’s psyche is hurt. The hurt may look very innocent but that makes a child feel insecure about themselves. The children lose faith in their own abilities. They learn wrong methods of behavior. I have seen some parents who verbally abuse their child in presence of the teacher. All the complaints they have about the child are made right in the presence of the teacher. This is a verbal thrashing. Somehow because the child cannot hit back, it is taken as granted by many adults that children can be verbally abused without hurting them. Adults feel good after verbally abusing them and feel that they know how to properly train a child. The facts are contrary. The child feels humiliated.

Whenever we talk to a child, we should put ourselves in their shoes and first think about how that will affect the child. Only after we are sure, we should speak to a child about sensitive issues. Verbally abusing a child is a crime in law, and also a bigger crime in the scheme of God.

Depression in the elderly is…unfortunately, a common occurrence due to loneliness, lack of family support or because of chronic illnesses. Very often depression in the aged is not reported and treated due to the social stigma attached with this condition or due to plain ignorance on part of the family of the elderly person. This not only doesn’t help them, but can worsentheir condition and make them susceptible to other ailments…including sometimes suicide.

Also, elderly depression can occur due to the death of a spouse…which increases lonliness. Also, side-effects from certain medicines or due to certain long-term illnesses like diabetes and arthritis can have a profound effect on depression. The depression must be treated as soon as possible. Without fast treatment, it can lead to suicidal tendencies on part of the patient or death from premature heart attack, stroke and other serious diseases. One group known to be at risk from depression in the elderly include widowed women. Others at high risk are those not being able to cope with stress in their lives. Low self-confidence due to diseases like cancer and loss of limb causing disfigurement can easily lead to depression. Many elderly may have a family history of depression and get depressed due to apprehension of dying. Some elderly may have an addiction to alcohol or drugs contributing to their depression.

So, what can be done to help depression in the aged? Counseling and a therapy of antidepressants can help. (note: always see a licensed therapist and physican). The therapist will prescribe antidepressants if they feel they are required. During initial prescriptions of these drugs the patient has to be watched carefully as the side-effects and results of a reaction can be serious. These medicines show their effect over a period of time since they are given in small doses. In fact, it wouldn’t hurt to have a medical alertalarm for the depressed person just in case they feel the need to contact emergency personnel.

Psychotherapy is very effective in dealing with depression in the elderly as the patient can share their feelings and insecurities with the therapist. This helps them to identify the main problem and initiates a curative process to overcome depression. Of course, a loving family can help tremendously. Depression is a sensitive issue which, can be treated with love and patience along with therapy and medication.

Nursing home abuse is an injustice to the elderly that occurs more often than not. What can be even more discouraging is when a victim of these abuses, finds the courage to speak up and there is no one around to hear their plight. Alcohol abuse in Massachusetts among its teenagers and its senior population are two diametrically opposite issues. There are various reasons that complicate both teenage alcohol abuse and senior alcohol abuse. Here we look into some points that cause problems in the alcohol abuse treatment in Massachusetts for these two age groups.


Teenage Alcohol Abuse in Massachusetts


The most significant roadblock on the way to acquiring teen alcohol abuse in Massachusetts is the overall ignorance of the target population. It has been found out that most of the people who are into juvenile alcohol habits in Massachusetts do not even know what they are in. Most of these people might have taken up the habit just because of the curiosity of it or because of peer pressure, but without understanding what its repercussions would be. It becomes very important to work out this ignorance in the minds of the people first. This is one of the reasons why counseling is such an important part of the teen alcohol abuse treatment in Massachusetts.


Then there is the problem of the way in which these people will react to the addiction. Being young, their bodies won’t be quite built to face the strong addictions that they are taking in. Ironically, their central nervous system will accept the addictive substance very easily but the body will not be able to bear the substance. This kind of dichotomy causes an intense condition within the person’s constitution.


At the same time, because the substance has become so well-accepted by the central nervous system, the temptations for more of it will be quite strong. This will make it all the more difficult to work out the addiction from the person’s system. Even the detox treatment will be difficult to carry out, because the typical medicines that are provided during a normal detox program will not be permissible for the young patients, considering their frail physiques.


Hence, the doctors face the very challenging problem of treating a strongly placed addiction using mild medicines. This is what greatly impedes alcohol abuse treatment in Massachusetts for the youngsters.


Senior Alcohol Abuse in Massachusetts


In the case of senior alcohol abuse, the biggest problem is of long term dependency. Most of the seniors who are into alcohol abuse today will have probably started out with their dependencies several years ago. It is quite natural that their bodies must have become completely immunized to the substance by now and that would make it extremely difficult to work out the substance from their physical system.


The detox is very difficult because of this reason. The patient will have built up a very intense accumulation of toxic substances within his or her body over the years and that is what will make it all the more difficult to make the person abstain and go through the entire detoxification process. The patient will definitely face a very strong withdrawal reaction. Detoxification for elderly persons always takes more time than that for youngsters, because the withdrawal effects are always experienced for a very long time and it becomes a very challenging task to work it out.


There is also the problem of a supplementary condition when alcohol abuse in seniors is involved. In most cases, after the body becomes immune to the euphoria that alcohol creates, the patient wants to try out stronger kinds of addictions. Prescription drug abuse is something that is very commonly found among patients undergoing alcohol abuse treatment in Massachusetts. It becomes a challenge to work at these two addictions at once.


Similarly, there could be some health complications or a mental condition that might make the alcohol treatment difficult for the seniors. This calls for dual diagnosis treatment. In such treatments, the patient is first led through a detox program, which lasts longer than a normal detox program because of the very strong withdrawal that people with dual conditions are wont to experience. If the patient has a mental condition that comes in the way of the detox treatment, then it will become a very complicated matter because a weak mental situation will not be able to make them effectively abstain from the substance or to go through the withdrawal conditions.


After this, the patients are led through an aftercare program and if there are mental issues making the treatment complicated, then they are provided with psychiatric counseling also. However, it is always difficult to provide aftercare to senior persons who are undergoing alcohol abuse treatment in Massachusetts because of the preconceived beliefs and their rigid mindsets which makes it very difficult for them to look at things with another perspective.

As I get closer to the designation of elderly, or as my 10 year old son says, “the ooooooollllllldddddd man”, I am curious about what the counseling field has to say about working with Boomers and elderly counseling.

All the folks I hang around with are very vital and engaged in life, and I am 61. Many of us have been hit hard by the current recession, and some are worried about finances, but I am not seeing anyone give up.

All of us have had to deal with losses and triumphs and illness and children and divorce and marriage and re-marriage and betrayal and medication and illness and death and funerals and disappointment and insight and wonder and awe and business reversals and business successes, and have created rich deep friendships and spiritual, physical, and cognitive healing paths throughout it all.

Speaking for myself, I am looking forward to a retirement, meaning I own my own time, where I earn my livelihood on the internet, and I am amazed at folks who do not see the opportunity there.

I work regularly on my physical and spiritual health, and I am paying close attention to my mental health, and using some recently developed software programs to keep my neuroplasticity and neurogenesis going. (Never heard of those new neuro-words? Nobody else had either until a few years ago, so read on please).

My workouts are in some respects stronger than those I did 40 years ago, and I just do not feel right if I don’t work up a good sweat.

The place where I break down is in nutrition, I eat larger portions than I need, and can eat for comfort rather than nutrition, which happens when I am tired.

So far, I am not finding a great deal of information about counseling for the elderly that does not deal with illness, although I have had some care givers in my domestic violence classes, so that I know caring for an aging parent is very difficult.

Elderly counseling is a new field, and it looks like there are programs that offer a degree or a certification for that field.

The issues that are covered in those programs are final life cycle stage, the aging mind, changing family systems, multicultural issues of aging, planning retirement, family issues, sexuality, security, illness and dependency, bereavement (widow or widower), community resources, advocacy, and life review or generativity.

Certain groups show potential for higher counseling needs including the sick and disabled, the disadvantaged, minorities, prisoners, substance abusers, homosexuals, and the single or widowed.

Elderly Counseling and Wellness

The marketers have not given up on us Baby Boomers, even though the counselors are still a bit behind the eight ball.

The marketers are looking out for our pocket books, , and offering us wellness, and supplements, and antiaging pills and potions, and coaching programs, and there are marketing campaigns aimed at just us, as there have been since we began to arrive enmass after WWII.

There are some tools folks that I think are very good elderly counseling.

One of them has been put together by Michael Merzenich,Ph.D. who is a leading researcher in the new field of neuroplasticity.

I first came across Merzinich’s work when I read a book by Norman Doidge, MD, about a year ago, called THE BRAIN THAT CHANGES ITSELF.

Merzinich was talking enthusiastically about the potential of our brains at any stage of life, if we continued to take care of the ‘pillars of brain fitness’ and challenged our neurons with novel learning experiences.

For decades, neuroscience has taught us that our brains were fixed and that we could only look to slowly losing them until we were sent off to the home.

Merzenich and other researchers are discovering that nothing could be further from the truth.

In fact, the IMPACT study just published in April of 2009 indicates that there is great value to computerized brain fitness programs like the The Posit Science Brain Fitness Program, created by Merzenich’s company.

Brainfit for Life is a really neat book written by Simon Evans,Ph.D. and Paul Burghardt,Ph.D. who are neuroscientists at the University of Michigan. They write for the layperson, and they have culled the neuroscientific research for hints that you and I can use to keep our brains alive and vibrant at any age. They say there are some pillars of brain fitness that we can attend to, which are important in us keeping our wits about us.

Those pillars are, physical exercise, and I exercise with guys at the YMCA who are in their 80′s, and they are there every day.

Even at 61 they call me ‘young man’, like I could not have learned anything about life.

So I like to use the Scott and Angie Tousignant model of physical exercise when I am not at they YMCA. If you go part way down the page that the blue link takes you to, you will meet two of the Tousignant students who are in their 80′s and began to exercise to make travel easier.

Stress management is a key piece of the elderly counseling puzzle, and the best stress managers there are would be physical exercise and deep breathing.

They are free and we are built for them.

I tell my anger management clients that deep breathing is good for them, and they nod sagely and go back to very shallow breathing which actually induces a stress response.

So I use a tool called Heartmath or heart rate variability biofeedback which teaches clients on their PC to regulate the time between heart beats, which is a feel good experience, and leaves them with an internal bath of DHEA, the antiaging hormone, rather than adrenaline and cortisol, the aging hormones.

Recognizing Nursing Home Abuse and Neglect

All residents in nursing homes are entitled to receive quality care and live in an environment that improves or maintains the quality of their physical and mental health. This entitlement includes freedom from neglect and abuse.

WHAT CONSTITUTES NEGLECT AND ABUSE?
Neglect: Neglect is the failure to care for a person in a manner, which would avoid harm and pain, or the failure to react to a situation which may be harmful. Neglect may or may not be intentional. For example, a caring aide who is poorly trained may not know how to provide proper care. Examples include:


Incorrect body positioning — which leads to limb contractures and skin breakdown;

Lack of toileting or changing of disposable briefs — which causes incontinence and results in residents sitting in urine and feces, increased falls and agitation, indignity and skin breakdown;

Lack of assistance eating and drinking — which leads to malnutrition and dehydration;

Lack of assistance with walking — which leads to lack of mobility;

Lack of bathing — which leads to indignity, and poor hygiene;

Poor handwashing techniques — which leads to infection;

Lack of assistance with participating in activities of interest — which leads to withdrawal and isolation;

Ignoring call bells or cries for help.

Abuse: Abuse means causing intentional pain or harm. This includes physical, mental, verbal, psychological, and sexual abuse, and intimidation. Examples include:
Physical abuse from a staff member, another resident, or visitor from outside the facility — including hitting, pinching, shoving, force-feeding, scratching, slapping, and spitting;

Psychological or emotional abuse — including berating, ignoring, ridiculing, or cursing a resident, threats of punishment or deprivation;

Sexual abuse — including improper touching or coercion to perform sexual acts;

Substandard care which often results in one or more of the following conditions — immobilization, incontinence, dehydration, pressure sores, and depression;

Rough handling during care giving, medicine administration or moving a resident.

REPORTING NEGLECT AND ABUSE

It is a violation of State and Federal law for any person, including facility staff, volunteers, visitors, family members or guardians, or another resident, to neglect or abuse a resident.
Anyone can and should report neglect and abuse. If you suspect neglect or abuse, or if a resident tells you they are experiencing this problem, it is important to believe the resident and REPORT THE ALLEGATION IMMEDIATELY. This will help prevent further suffering by any resident.

Many states have laws that require the reporting of abuse and neglect. Find out what your state requires.

Put your report in writing, date it, and keep a copy. Convey as much information as you can about the situation. Remember to include:

WHO The name of the victim, including age and address; the name of the facility and the people responsible for the victim’s care; the identity of the person who you believe abused or neglected the resident;
WHAT The nature and extent of harm and any physical signs of abuse or neglect; any previous incidents; what happened;
WHERE and WHEN the place where the incident happened and time and date of the incident.
Make Your Report To:
The nursing home’s administrator, director of nursing, and social worker

The state or local Ombudsman

The local police or State law enforcement

Adult Protective Services agency – which is part of the Department of Social Services

The state survey agency that licenses and certifies nursing homes (often in the Health Department)

A citizen advocacy group or other church or community group that visits regularly.

Keep trying until you get the assistance you need.

AFTER THE REPORT:
Follow up with the resident and facility to make sure the neglect or abuse has stopped.

Follow up with the person or agency conducting the investigation. Ask for written copies of investigative reports.

If the perpetrator is charged with abuse or neglect, the charge will be referred to the state licensing authority. If the guilty person is a nurse aide, the charge will be reported to the state nurse aide registry. This registry is used by nursing homes to prevent abusive aides from working with the elderly. Nursing homes are required to check the registry before hiring a person.

If all the safety options fail, you may have to contact the local media, the U.S. Justice Department, or seek private legal assistance.

Both club and prescription drug abuses are quite significant in the overall problem of drug abuse in Wyoming. These are apart from the other common forms of addiction such as heroin addiction, cocaine addiction, marijuana addiction and even alcohol addiction, which is the most prevalent form of chemical dependency in the state.


Here we shall see some details on these two forms of drug abuse in Wyoming. Here are some statistics and trends on club and prescription drug abuse in the state.


Club Drug Abuse in Wyoming


By definition, club drugs are those that people use in party and rave circuits. These are drugs that are typically popular among the youth, because these are the kinds of people that frequent such areas. The main forms of club drugs that are popular in the state are methamphetamine and ecstasy.


Methamphetamine is one of the most popular forms of club drug addiction in the state. This substance was not present on the drug addiction scene of Wyoming until about ten years ago, but in the last few years, the drug has become much more prevalent than other forms of addiction in the state. Methamphetamine comes into Wyoming mainly from Mexico, through road trafficking methods. The drug is brought here both in its original form a purer form known as crystal meth, locally known as ice.


Another source of methamphetamine in Wyoming is through the various meth labs that are secretly operating within the state. These labs work through the agencies of one or two people and can produce up to ten pounds of methamphetamine and crystal meth each day from some crude materials such as cough syrups, antifreeze and other such easily available materials.


Though there have been various crackdowns and patrolling on the highways have become stricter in recent times, methamphetamine and crystal meth still continue to flow freely into Wyoming, thus adding considerably to the problem of drug abuse in the state.


Other popular club drugs in the state are MDMA (also known as Ecstasy) and GHB. These drugs are sourced from the state of Colorado. They are locally distributed in the youth-centric areas of the state such as in nightclubs and rave party zones. These drugs are popular because they are cheaply available and they have a capacity to produce an immediate high. Psilocybin mushrooms and LSD are also popular on the scene of club drug abuse in Wyoming among the other substances already mentioned.


Prescription Drug Abuse in Wyoming


Prescription drugs are those drugs that are administered for the treatment of certain diseases or illnesses. However, a lot of these substances are habit forming. They are used by a wide cross section of people in Wyoming for recreation. This contributes to the problem of prescription drug abuse in Wyoming.


There are several drugs that are a part of prescription drug abuse in the state. The most significant of these drugs are Valium, Vicodin and Dilaudid. Valium is a benzodiazepine and th others are painkillers. They have a mild habit forming effect due to which they can be used for recreation.


This causes several supplementary problems in the state, such as making fake prescriptions, shopping for prescriptions, etc. There are several healthcare professionals involved in this activity. In any case, the problem of prescription drug abuse in Wyoming is quite prominently present within the state.


This problem is quite significant in two groups of people in the state. The most significant population is the senior population. These people are usually prescribed these drugs due to geriatric problems. The substances can become habit forming over time and this makes the addiction treatment more difficult too. This is a common issue in senior alcohol and drug abuse treatment in the state. The main reason why the drug abuse is common among the seniors is because of the ready availability (through prescription) to them.


The second group of people who abuses prescription drugs is the adolescents. These youngsters frequently find these substances within their own homes and that is the reason why they also have a ready availability of the substance. Youngsters who check in for drug abuse treatment in Wyoming are often found to have supplementary problems of a prescription drug abuse, most of which are narcotic painkillers that have been prescribed by a physician to an elderly person in their own homes.


These two kinds of drug abuse form a big share of drug addiction in the state. Several methods of treatment are used in various rehab centers to combat prescription and club drug abuse.
